הנתבעים הצהירו, כי הם חששו שהסכסוך המתוקשר עם התובעים יגרום נזק לשמה הטוב של קאנווסט, אשר באותה עת התכוונה להשקיע בישראל, ואף לשמה הטוב של משפחת אספר, המעורבת בפרויקטים פילנתרופיים בישראל. אשר על כן, הנתבעים החליטו לשכור את שירותיו של משרד יחסי ציבור, שיסייע להם לבטא את עמדתם בתקשורת הישראלית וישדר לתובעים ולציבור כי ברצונם להמשיך עם העסקה (ראו סעיף 10 לתצהיר לייפסיק; סעיף 10 לתצהיר אספר).
הנתבעים הצהירו עוד, כי כל כוונתם הייתה לדאוג לכך שהכיסוי התקשורתי ישקף נאמנה את העובדות בשטח ויבטא גם את עמדתם. הנתבעים טענו כי הם מעולם לא התכוונו "להרוס את התובעים" או לפגוע בהם ובלשונם:
"Our whole intention was to bring the facts to light: to bring our side of the story to the Israeli media and public, and prevent a one-sided version of the dispute from being told. We never intended to "destroy" or damage the plaintiffs. We wanted to make sure that as best we could under the circumstances (given that the preliminary injunction was issued by a United States court and not a Israeli court) the plaintiffs abided by the TRO and later the preliminary Injunction, thereby preserving the Newspapers so it could be transferred to CanWest, should the arbitration be successful. Also through bringing the true facts to light we were attempting to preserve CanWest's and the Asper's reputation, Standing and goodwill in Israel."

לייפסיק נשאל מדוע חשב שלציבור הישראלי יש עניין בקנווסט, שאין לה פעילות עסקית בארץ, והשיב (עמ' 80 ש' 3 עד עמ' 83 ש' 14):
"Q .But why did you care what the Israeli public would think about CanWest?
A. We do care.
Q. Why?
A. Well, first of all we had a number of people within the Jerusalem post that were coming and calling us, management that we had engaged and had been committed to try and to tend with the idea that we were going to take the newspaper to a new level, they had called us and came to us that as far as they could see we had reneged on the deal we wanted to be in a position to get our … that we were actually prepared in fact Mr. Ezor did not see, I think as I mentioned elsewhere we had through CanWest a whole network of business relations where it was important for our reputation.
