באשר לאופן שבו, לטענת הנתבעים, נדחתה תכנית המשחק "מכל וכל" הצהיר אספר, כי הדבר נעשה במהלך שיחת וועידה טלפונית, אשר התקיימה בין אספר, לייפסיק, רונן ומורל, במועד כלשהו בין תכנית המשחק מיום 2.2 למסמך ההתקשרות מיום 3.2:
".. We subsequently had a conference call with the other defendants and with Motti Morel, and we told him we have to refute negative things being said about us and also have him forward us clippings of newspaper articles about our dispute with the plaintiffs. However, in terms of the aggressive steps the plan recommended we said we wanted to take the high road and just make sure people know our side of the story. Nothing else had anything to do with what we wanted to accomplish."

היינו, לטענתו, הנתבעים דחו את תכנית המשחק וביקשו ממוטי מורל ללכת בדרך המלך: High Road"". אותה "High Road", משמעותה, לשיטת אספר היא להמנע מנקיטה בצעדים שליליים או אגרסיביים (פרוטוקול מיום 9.1.12 עמ' 95 ש' 19-24):

".. Well, what do you think taking the high road is? Taking the high road is not doing anything negative or aggressive other than what we wanted to accomplish which is to get our side of the story, we can express it different ways and different testimony but it was all, it all means the same thing..."
ובהמשך (עמ' 96 ש' 24 עד עמ' 97 ש' 6):
".. Well I can only repeat myself, it’s the same, it means the same thing. Rejecting it, rejecting it out of hand, saying no, taking the high road, taking the high road is a very, you know a very often used term in business which means don’t get into the gutter, don’t do things that are unbecoming of a public company or a reputable company, and that’s what it all means, that’s why it means the same thing."
אין מקום לקבל את גרסת הנתבעים לעניין זה, בעיקר לאור העובדה שהנתבעים העידו כי נוהלה שיחה ארוכה בין כל המעורבים, ויום לאחריה נחתם מסמך ההתקשרות. בין לבין אין כל מסמך המסכם את השיחה ומבהיר כי הנתבעים דחו את התכנית.
