ב. ההסבר המרשיע הוא ההסבר הסביר היחיד לראיות.
כך למשל בעניין V.US 178F 2d. 363 Pevely Dairy, בו בוטלה הרשעתם של ספקי חלב באשמה של תיאום מחירים, שהתבססה על ראיות נסיבתיות, נאמר:
"In order to justify a jury finding a verdict of guilty based on circumstantial evidence, the facts must not only be consistent with the guilt of the defendants, but they must be inconsistent with any other reasonable hypothesis that can be predicated upon the evidence. Stated another way, not only must each fact relied upon to show guild, be proved beyond a reasonable doubt, but such fact must be consistent with all other facts introduced in a chain of circumstances, and such facts must further be inconsistent with any other rational conclusion than that of guilt of the defendants…
Where circumstantial evidence is relied upon to establish the conspiracy or any other essential facts, it is not only necessary that all the circumstances concur to show the existence of such conspiracy and facts sought to be proved, but such circumstantial evidence must be inconsistent with any other rational conclusion". (p. 367)
באותו עניין דובר בנאשמים שגבו מחירים דומים עבור החלב ששיווקו ואף העלו מחירים באופן סימולטני. בנוסף, הובאו ראיות על כך שמספר שנים לפני התקופה הרלוונטית לכתב האישום התקיימו פגישות בין הנאשמים, בהן נידונו עליות מחירים. בית המשפט קבע שאין די בכך על מנת להרשיעם בעבירה של הסדר כובל (Conspiracy), שכן המחירים הדומים ועליות המחירים הסימולטאניות יכלו לנבוע גם ממניעים כלכליים לגיטימיים (לנאשמים היו עלויות דומות), ולא מתיאום.
כך גם בעניין Mastsushita Electric industrial Co. v. Zenith Radio Corp. 475 U.S 574 (1986) קבע בית המשפט העליון הפדרלי, כי אפילו תובע אזרחי הטוען טענה של הסדר כובל בהתבסס על ראיות נסיבתיות, צריך להראות שההסבר לראיות שלפיו נכרת הסדר כובל הנו לא רק הגיוני, אלא אף הגיוני יותר מאשר הסבר אלטרנטיבי לראיות, לפיו מדובר בפעולה שאינה מתואמת, או בתיאום שאינו אסור:
"…conduct as consistent with permissible competition as with illegal conspiracy does not, standing alone, support an inference of antitrust conspiracy…"
