24. המשיבים טענו, כי הקצין הסתיר מהן את מצבו הרפואי האמיתי, וחרף הצהרתו, לא קיבל את החיסונים שהיה אמור לקבל.
עם כל הכבוד, המסמכים הרפואיים שצורפו, מלמדים אחרת. חוזה העבודה נכרת בתאריך 8.3.2021, ולפי הצהרת הקצין (שצורפה לתגובת המבקשת לתשובה שהוגשה מטעם המשיבות), הוא עלה לכאורה על האנייה לראשונה בתאריך 9.3.2021. סימניה הראשונים של המחלה התגלו רק בתאריך 25.3.2021. בהינתן שתקופת הדגירה של נגיף הקורונה היא עד 14 ימים, הרי שלכאורה הקצין נדבק בנגיף בתקופה שבין ה- 11.3.2021 ל- 25.3.2021, דהיינו לאחר שכבר שרת על האנייה.
מכל מקום, כמי שקיבל טיפול רפואי אצל המבקשת, הקצין חייב לשאת בתשלום דמי האשפוז. מכיוון שעל פי חוזה העבודה שנכרת עמו, על המשיבה מס' 2 לשאת בתשלום, כי אז מדובר בתשלום, שהקצין זכאי לתבוע "עקב העסקתו בכלי השיט". זכות התביעה של הקצין, אשר הומחתה למבקשת, היא לכאורה תביעה שבהחלט באה בגדר הוראת סעיף 41(4) לחוק הספנות (כלי שיט). על כן, חוב האשפוז הוא חוב מובטח לפי סעיף 41(4) לחוק, וככזה הוא יוצר שעבוד ימי, ומקים עילה למעצר האנייה.
25. זאת ועוד:
המשיבה מס' 2 מפעילה אנייה תחת דגל פנמה, ומשכך חייבת היא בחובות שמטיל הדין בפנמה על מפעילי אניות, המפליגות תחת דגל המדינה. בתאריך 6.2.2009, אימצה פנמה את האמנה הבינלאומית לעבודה בים, שכותרתה "Maritime Labour Convention", משנת 2006. כותרת הפרק הרביעי לאמנה זו הוא "Health protection, Medical Care, Welfare and Social Security Protection", ובחלק הראשון לפרק זה נקבע:
"Regulation 4.1 – Medical care on board ship and ashore
Purpose: To protect the health of seafarers and ensure their prompt access to medical care on board ship and ashore
1. Each Member shall ensure that all seafarers on ships that fly its flag are covered by adequate measures for the protection of their health and that they have access to prompt and adequate medical care whilst working on board.
2. The protection and care under paragraph 1 of this Regulation shall, in principle, be provided at no cost to the seafarers.
3. Each Member shall ensure that seafarers on board ships in its territory who are in need of immediate medical care are given access to the Member’s medical facilities on shore.
4. The requirements for on-board health protection and medical care set out in the Code include standards for measures aimed at providing seafarers with health protection and medical care as comparable as possible to that which is generally available to workers ashore."
