"The case involves the familiar competition between freedom of expression and respect for an individual's privacy. Both are vitally important rights. Neither has precedence over the other. The development of the common law has been in harmony with articles [8 and 10] of the Convention.
The values embodied in articles 8 and 10 are as much applicable in disputes between individuals or between an individual and a non-governmental body such as a newspaper as they are in disputes between individuals and a public authority" (Campbell v MGN Limited [2004] AC 457, paras. 12, 20-21).

"When both these articles are engaged a difficult question of proportionality may arise… [I]n deciding what was the ambit of an individual's 'private life' in particular circumstances courts need to be on guard against using as a touchstone a test which brings into account considerations which should more properly be considered at the later stage of proportionality.
…[T]he degree of intrusion into private life, and the extent to which publication was a matter of proper public concern… could be a recipe for confusion" (Id, at paras. 20-21).
באורח קונקרטי מצאה דעת-הרוב, כאמור של שלושה מבין חמשת שופטי-ההרכב, כי הפגיעה בפרטיותה של הידוענית הייתה, בנסיבות-המקרה, מצומצמת. היא עצמה הקדימה והתייחסה, בראיונות פומביים, לשאלת התמכרותה לסמים ולטיפול בהתמכרות שכזו, גם אם על דרך של הכחשה ואי-אמירה של אמת. פרטיו המסוימים של הטיפול, שהופיעו במאמרים, נראו בנסיבות הללו לבית-המשפט ענינים אשר, מחד גיסא, מצויים בשולי-הפגיעה בזכות לפרטיות ומאידך גיסא תורמים צבע וחיות ראויים לפרסום העיתונאי. כתב השופט Lord Nicholls:
"On the one hand, publication of this information in the unusual circumstances of this case represents, at most, an intrusion into Miss Campbell's private life to a comparatively minor degree. On the other hand, non-publication of this information would have robbed a legitimate and sympathetic newspaper story of attendant detail which added colour and conviction" (Id, at para. 28).
