השופט גלעדי הביא דברים אלה בפסק הדין נושא הערעור והוסיף:
"במקרה דנן היה מעמדם של התובעים מיוחד במינו וזאת עקב אפי המוצרים של חברת ק.א. אותם מכרו בישראל".
דברים אלה אינם מקדמים אותנו בהגדרת מהות היחסים בין הצדדים.
בלבול מושגים בין הסוכן (agent) על סוגיו השונים במובן המסחרי לבין השלוח במובן המשפטי קיים לא רק אצלנו אלא גם באנגליה. אין זהות בין הסוכן במובנו המסחרי לבין הסוכן במובנו המשפטי. הסוכנות המסחרית יכולה ללבוש צורות שונות. הסוכן יכול להיות שלוח במובן המשפטי אך אינו חייב להיות כזה.
