והואיל והחצר הזאת משמשת מאז הבנותה בחלקה בית הכנסת בשם 'בית יהודה' ובחלקה בית לימוד קודש לתינוקות של בית רבן.
והואיל והבעלים הרשומים הנז' בהתאם לזה בקשו לעשותה הקדש דתי עולם לתעודתו הנז'.
לכן הננו מחליטים ומקיימים שהחצר הנז' הוא הקדש עולם לא להמכר ולא להגאל כי אם לשמש כמאז ומתמיד לבית תפילה לגברים ולנשים לקהלת הקודש של גרי השכונה בית יעקב והסביבה הנודע בשם בית כנסת " בית יהודה" ולבית למוד קודש לתינוקות של בית רבן.
הנהלת הקדש זה תהי' על ידי המבקשים ואחרי אריכות ימיהם ושנותיהם ע"י אפוטרופוסים שימונו על ידינו."
על שטר זה חתומים הרבנים חזקיה שבתי, יעקב קלמס ויוסף מ' הלוי.
כשנתיים לאחר מכן, במרץ 1944, פנה מר חיים צבי גרינברג לבית המשפט המחוזי המנדטורי בבקשה להכרזת קרקעות בית הכנסת בתור הקדש צדקה, כמשיבים הופיעו ה"ה אשכנזי וסלומון, גבאי ההקדש.
לאחר שמיעת ב"כ הצדדים הורה השופט מר בודילי על הכרזת הקדש צדקה בנכס בית הכנסת. להלן פסק הדין שניתן בירושלים על ידי השופט בודילי:
NATURE OF APPLICATION: Application for declaring property parcel no. 17 block 73, Jerusalem to be a Charitable Trust, according to section 37(1) of the Charitable Trusts Ordinance.
ORDER
Upon reading the application filed by advocate M. Gratch on behalf of the applicant and the affidavit in support thereof, and upon hearing the advocates of both parties it is hereby ordered and declared that the property, site and buildings thereon, as shown in the plan marked 'A', which is situated in the Beth-Yaacov quarter, Jerusalem, the boundaries of which are North, West and South – Roads; east – Kokia and which is registrared in the Registers of the Urban Property tax, Jeruslarn, as parcel 17 in Block 73, is a Charitable Trust in accordance with the provisions of the Charitable Trusts Ordinance, for the purpose of a synagogue under the name 'Beth-Yehuda", and a school for religious teachings for the benefit of the jewish Ashkenazic inhabitants of Beth-Yaacov quarter and neighborhood and that it be so registered in the registers of the Land Registery, Jerusalem.
It is further ordered that Messrs Shmariah Ashkenazi, Tuvia Salomon and haim Zvi Grinberg, Moshe Ashkenazi and Shimon Avrahmi be appointed
