לעומתו טען בא-כוחה המלומד של המערערת (התובעת בבית המשפט קמא), כי האמצאה מתייחסת להאד הולוגרפי בעל שדה ראייה רחב. המערכת אמנם מורכבת משילוב של מספר רכיבים, שחלקם אולי היו ידועים קודם לכן, אך המדובר בפטנט לקומבינציה (combination patent), שהוענק לגבי צירוף של מכלול הרכיבים ליחידה אחת, ואין לפרק את האמצאה לרכיביה ולהבחין בין רכיבים שהיו ידועים לכאלה שלא היו ידועים. האמצאה בפטנט לקומבינציה מתבטאת בעצם השילוב הסופי של מספר רכיבים המוליד מערכת שלמה חדשה שלא נוצרה קודם לכן, ואשר יש בה צעד המצאתי.
