(iii) Within such sole purpose Entity the Desalination Expert actually performed the process design of the applicable project(s).
b. In the event the Desalination Expert is the sole purpose Entity which was the Main Contractor of the project – there was no other entity which actually performed the process design of the applicable project pursuant to an agreement with the Desalination Expert of otherwise."
13. באשר לתפעול מתקן התפלה בסעיף 5.3.1 להזמנה לשלב המיון המוקדם נקבע כי:
"The Participant is required to demonstrate that either it or one of its Members or one of its Major Subcontractors (the "O&M Expert") has successfully operated and maintained:
a. During a period of twenty four (24) months within the past seven (7) Years – one or more desalination or other water or waste-water treatment facilities. With an accumulated production capacity of not less than 150,000 m³/day of which at least one (1) facility is a sea-water desalination facility based on the reserve osmosis process design, with production capacity of not less than 50,000 m³/day. Such facilities should have a demonstrated record, readily available for inspection of successful performance during the entire commercial operation phase; or
b. During a period of twenty four (24) months within the past seven (7) Years – one (I) sea-water desalination facility based on the reserve osmosis process design, with production capacity of not less than 100,000 m¹/day. Such facility should have a demonstrated record readily available for inspection of successful performance during the entire commercial operation phase.

14. המדובר אפוא בתנאי סף המחייב הוכחה של ניסיון בביצוע תכנון, הקמה, התקנה והרצה של מתקן התפלה אחד או יותר בטכנולוגיה של אוסמוזה הפוכה, שלו תפוקה של לפחות 150,000 מ"ק ליום, כאשר המציע ביצע בפועל כחלק מישות ייעודית את הפעולות האמורות, והחזיק לפחות 30% מאותה ישות. עוד נקבע כי ככל שהישות הייעודית הייתה מיזם משותף, הרי שמומחה ההתפלה היה אחראי ביחד ולחוד לביצוע הפרויקט, וביצע בפועל את התכנון של התהליך.
