15. בכל הנוגע לסעיפים אלה מסרה ועדת המכרזים בשלב מאוחר יותר, ביום 19.8.18 הבהרה באשר לפרשנות הסעיפים 5.1.1 ו-5.3.1 (שאלה 3, נספח 15 לעתירה):
The Tender Committee hereby clarifies that for purposes of Section 5.1.1 and 5.3.1 the Tender Committee has a wide discretion as to what will be regarded a "successful performance" mainly focusing on extreme cases of gross failures of design or installation construction.
16. תשובה רלוונטית אחרת לשאלת הבהרה היא התשובה לשאלה 16 בקובץ ההבהרות מס' 1 של ועדת המכרזים מיום 19.7.18 שבה נכתב בקשר לדרישת הניסיון כי:
"It is hereby clarified that under section 5.1.1 it is required that the Desalination Expert has executed the design, installation and commissioning either by itself as a "Main Contractor"…
As such, In the event that any works were executed by a third party which was not a subcontractor of the Dealination Expert, the Desalination Expert cannot be regarded as executing such works, even if it was responsible for supervising the works."
17. במסמך הבהרה נוסף של ועדת המכרזים (שאלה 3, קובץ הבהרות 2 מיום 7.8.18) ניתנה הבהרה לגבי סעיף 5.1.2 העוסק בפעילות משותפת:
"In the event that the SPV was unincorporated joint venture – it is required that the Desalination Expert (i) held at least 30% of the SPV, (ii) was jointly and severally responsible for the execution of the project, and (iii) actually performed the process design of the project"
18. הוראות רלוונטיות אחרות במכרז נוגעות למסירת נתונים כוזבים או מטעים לוועדת המכרזים. המדובר בסעיף 9.7 למסמכי המכרז:
"The Tender Committee reserves the right to reject Bids which do not fully comply with the provisions of the event such Bids are partial reserved, lacking conditional, false or based on false or

misleading information, unless otherwise seceded by the Tender Committee as its sole direction".
In Addition, the Tender Committee is entitled, but is no way obligated to disqualify any Bidder or impose any continued participation in the Tender process in the following event".
Any other reason for which the Tender Committee deems that Bidder is not eligible to be announced as the Successful Bidder, including due to lack of credibility or reliability of such Bidder or any participator during the Per-Qualification Stage or the Tender Process. The Tender committee reserves its right to take any action, at its sole discretion, with respect to dishonesty of a Bidder or any Participator".
