1. בפני השגה על סירוב מחלקת סימני מסחר (להלן: "המחלקה") לקבל בקשה לרישומו של סימן מסחר 313542 (לא מעוצב) CENTER FOR FOURTH INDUSTRIAL REVOLUTION שהוגשה ביום 22.10.2018 (להלן: "הסימן המבוקש"). הבקשה הוגשה במספר סוגים:
1.1. סוג 16 עבור: Printed products; photographs; instructional or teaching material (other than apparatus); printing blocks; pamphlets; news bulletins; newspapers; publications; periodical magazines; manuals [handbooks]; printed research reports; all the aforesaid goods unrelated to the theme of a center for the fourth revolution.
1.2. סוג 35 עבור: Company networking services aimed at promoting discussion with a view to global, regional and industrial changes and issues; networking services for professional and economic purposes aimed at promoting discussion with a view to industrial, regional and global issues and changes; all the aforesaid services not provided via the center for the fourth industrial revolution; evaluation and compilation of mathematical or statistical data; analysis of mathematical or statistical data; recording services, transcription services, as well as data entry or compilation in the framework of evaluation of collected statistics; commercial business appraisal and market study services; organization of exhibitions and trade fairs for commercial and advertising purposes.
1.3. סוג 38 עבור: Provision of online chat rooms for social networking purposes, namely, for public-private cooperation and social, political, business and academic leader cooperation; telecommunication services, particularly in the fields of interactive communication networks, provision of access to an Internet platform; chat room services for social networking purposes
1.4. סוג 41 עבור: Organization, arranging and conducting of colloquiums, conferences, congresses, seminars, symposiums; organization of congresses and conferences for cultural and educational purposes with the purpose to promote discussions on industrial, regional and global changes and issues; education, namely, providing information about education; training in the field of business and economic leadership; entertainment, namely, holiday camp services; sporting activities, namely, organization of soccer or football games; holiday camp services (entertainment); organization of exhibitions for cultural or educational purposes; information relating to education; educational services; organization, hosting and conducting of seminars; award of recognition prizes; organization of exhibitions for educational purposes; publication of books; electronic publication of books and journals online; publication of texts other than advertising texts; entertainment and education information provided on-line from a computer database or the Internet; conducting training courses for others; information relating to entertainment or education provided on-line or via television, broadband and wireless communication media; correspondence courses; organization, hosting and conducting of colloquiums, conferences, congresses, seminars, symposiums, workshops (training); organization of competitions (education or entertainment); vocational guidance (education or training advice); training in the use of mathematical or statistical data.
2. הבקשה הוגשה כבקשה בינלאומית בשוויץ ביום 23.4.2018, ונרשמה שם כסימן מסחר מספר 1447909 בסוגים 16, 35, 38, 41.
3. הבקשה לרישום הסימן נדחתה במכתבי המחלקה בימים 2.9.2019, 16.1.2020, 22.3.2020, 23.8.2020, שכן צירוף המילים Fourth Industrial Revolutionאינו בעל אופי מבחין, ואין בהוספת המילים "center for" בכדי להעניק לסימן המבוקש אופי מבחין כך שיוכל לשמש כאמצעי לזיהוי מקור הסימן ביחס לטובין ולשירותים המוצעים. כן צוין כי הסימן דומה כדי להטעות לסימן רשום שמספרו 123395 ."Revolution"
4. לטענת המבקשת, הביטוי FOURTH INDUSTRIAL REVOLUTION נטבע על ידי מנכ"ל המבקשת, מר קלאוס שוואב, בכנס בינלאומי שנערך בדאבוס, שהינה פורום כלכלי גלובלי של מדינות רבות בעולם, עבור שיתוף פעולה בין קהילות בינ"ל בתחומי טכנולוגיות, והוא מזוהה עמה באופן בלעדי. כן טוענת המבקשת כי הסימן מזוהה עמה בקרב כל מדינות העולם.
5. לטענתה, הסימן המבוקש איננו תיאורי, והוא לכל היותר מרמז. עצם העובדה שהסימן כולל מילים רבות, אינה הופכת אותו לסיסמא בעלת מסר שיווקי. המבקשת הדגישה כי אינה מבקשת סימן מסחר על הביטוי Fourth Industrial Revolution אלא רק על הצירוף
Center For Fourth Industrial Revolution. המבקשת אף השוותה למרכזים נוספים ששמם נרשם כסימן מסחר כגון האוניברסיטה העברית בירושלים, או המרכז הבינתחומי הרצליה.
6. לטענת המבקשת, המרכז פעיל במדינות רבות בעולם וחולש על תחומים רבים. המרכז מפגיש בין ממשלות, חברות מובילות ומומחים ברחבי העולם לצורך עיצוב משותף של מדיניות של ממשלות בהקשר של טכנולוגיה, וחזונו של המרכז הוא לעצב את ההתפתחות ואת השימוש בטכנולוגיה בדרכים שיהיה בהן כדי למקסם את התועלת ולמזער סיכונים. לטענתה גם קיימים הסכמים בין הפורום הגלובלי (הכלכלי) לבין מדינת ישראל שפורסמו על ידי רשות החדשנות.
7. המבקשת מעוניינת לבסס את בקשתה לרישום הסימן בישראל על רישומו המקביל בשוויץ (סימן מסחר מספר 725315) בהתאם להוראות סעיף 16 לפקודת סימני מסחר [נוסח חדש] התשל"ב-1972 (להלן: "הפקודה").
8. כן טוענת המבקשת כי הסימן נרשם במדינות שונות בעולם כגון בריטניה, רוסיה והאיחוד האירופי, אוסטרליה, יפן וארה"ב.
